Welcome to Calorie Camera (“we”, “us”, “our”), accessible at caloriecamera.fit and via our Apple iOS app (“App”, “Service”). These Terms of Use (“Terms”) form a legal agreement between you and Calorie Camera. By downloading, installing, accessing, or using the App, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the App.

01. Who we are and eligibility

Calorie Camera is a calorie-tracking app that lets you take photos of food to get AI-estimated calories and nutrients, track progress, and get insights.

• You must be at least 13 years old (or 16 where required by local law) to use the Service. If you are under 18, you confirm you have parental or guardian consent.
• You are responsible for ensuring use of the App complies with all laws in your jurisdiction.

02. License — Apple App Store

We grant you a personal, non-exclusive, non-transferable, revocable, limited license to install and use the App on Apple-branded devices you own or control, as permitted by the Apple Media Services Terms and Conditions and the App Store rules.

• You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or attempt to extract source code from the App, except where such restriction is prohibited by law.
• You may not use the App for any unlawful, infringing, or abusive purpose.
• This license will terminate automatically if you violate these Terms.

Apple acknowledgment: These Terms are concluded between you and Calorie Camera only, and not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to furnish maintenance or support for the App. In the event of a failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price if applicable, to the maximum extent permitted by law Apple will have no other warranty obligation. Apple is not responsible for addressing claims relating to the App, including product liability, legal compliance, or consumer protection claims. Apple is not responsible for investigation, defense, settlement, or discharge of third-party intellectual property infringement claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

03. Accounts

Some features may require an account. You agree to provide accurate information, keep your credentials confidential, and notify us of any unauthorized use. You are responsible for all activity under your account. You may request deletion of your account at any time — see Delete my account.

04. Subscriptions, trials & payments (Apple In-App Purchase)

Calorie Camera may offer auto-renewable subscriptions (e.g., monthly, yearly) and/or lifetime access sold exclusively through Apple In-App Purchase.

• Billing: Payment is charged to your Apple ID at confirmation of purchase.
• Auto-renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• Manage / cancel: You can manage or cancel subscriptions in iOS Settings > Apple ID > Subscriptions, or via the App Store. Cancellation takes effect at the end of the current billing period. Deleting the App does not cancel your subscription.
• Free trials: If offered, any unused portion of a free trial is forfeited when you purchase a subscription, where applicable. Trials automatically convert to paid subscriptions unless cancelled before the trial ends.
• Price changes: We reserve the right to change prices. Any price change will comply with Apple’s subscription price-change rules and notice requirements.
• Refunds: All purchases are processed by Apple and subject to Apple’s refund policies. We cannot directly issue refunds for App Store purchases — please request via Apple Support / reportaproblem.apple.com.

05. Health, nutrition & AI disclaimer

Calorie Camera is not a medical device and does not provide medical advice.

• Calorie, macro, and nutrient estimates are generated by artificial intelligence from photos and user input and are estimates only. They may be inaccurate or incomplete.
• Do not rely on the App for diagnosis, treatment, prevention of disease, eating-disorder management, pregnancy, or other medical decisions. Always consult a qualified healthcare professional.
• If you have a medical condition, allergy, eating disorder, or are pregnant/nursing, consult your doctor before using the App or changing your diet.
• Food images you upload may be processed temporarily on our servers for analysis, as described in our Privacy Policy.

06. Acceptable use

You agree not to:

• Upload unlawful, harmful, hateful, sexually explicit involving minors, infringing, or otherwise objectionable content.
• Upload photos of other people without their consent, or sensitive personal data you do not wish to be processed.
• Abuse, disrupt, overload, scrape, or circumvent security, rate limits, or access controls of the Service.
• Use the Service to develop competing models by systematic scraping or extraction, or to mislead others with AI-generated outputs.
• Violate Apple App Store rules, privacy rights, or intellectual property rights.

We may suspend or terminate accounts that violate these rules, with or without notice where permitted by law.

07. Intellectual property

The App, website, logos, design, text, and software are owned by Calorie Camera or its licensors and protected by intellectual property laws. Except for the limited license above, no rights are granted. You retain rights to the food photos and content you upload (“User Content”), but you grant us a worldwide, non-exclusive, royalty-free license to host, process, and display such content solely to operate and improve the Service, in accordance with our Privacy Policy. Feedback you provide may be used by us without restriction or compensation.

08. Third-party services

The Service may use third-party providers (e.g., AI analysis, analytics, crash reporting, cloud hosting) and may contain links to third-party sites. We are not responsible for third-party content, policies, or practices. Your use of Apple services remains subject to Apple’s terms.

09. Termination

You may stop using the App at any time and delete your account via Delete my account. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. Sections concerning IP, disclaimers, liability, and governing law survive termination.

10. Warranty disclaimer & limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT NUTRITIONAL ESTIMATES WILL BE CORRECT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALORIE CAMERA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100 / $100 IF YOU PAID NOTHING. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE CONSUMER LAW.

11. Changes, governing law & disputes

We may update these Terms from time to time. We will post changes on this page with a new update date and, where appropriate, notify you in the App. Continued use after changes take effect constitutes acceptance. These Terms are governed by applicable law without regard to conflict-of-law rules. EU consumers retain mandatory consumer protections of their country of residence. For questions or complaints, contact support@caloriecamera.fit first — we will try to resolve disputes informally.

Bienvenido a Calorie Camera («nosotros»), accesible en caloriecamera.fit y a través de nuestra app para Apple iOS («App», «Servicio»). Estos Términos de uso («Términos») constituyen un acuerdo legal entre tú y Calorie Camera. Al descargar, instalar, acceder o usar la App, aceptas estos Términos y nuestra Política de privacidad.

01. Quiénes somos y elegibilidad

Calorie Camera es una app de registro de calorías que permite tomar fotos de comida para obtener estimaciones de calorías y nutrientes generadas por IA, seguir tu progreso y recibir información personalizada.

• Debes tener al menos 13 años (o 16 donde lo exija la ley local) para usar el Servicio. Si eres menor de 18 años, confirmas que cuentas con el consentimiento de tus padres o tutores.
• Eres responsable de que el uso de la App cumpla con las leyes de tu jurisdicción.

02. Licencia — Apple App Store

Te otorgamos una licencia personal, no exclusiva, intransferible, revocable y limitada para instalar y usar la App en dispositivos de marca Apple que poseas o controles, según lo permitido por los Términos y Condiciones de Apple Media Services y las reglas del App Store.

• No puedes copiar, modificar, distribuir, vender, alquilar, realizar ingeniería inversa, descompilar ni intentar extraer el código fuente de la App, salvo que la ley lo prohíba.
• No puedes usar la App con fines ilícitos, infractores o abusivos.
• Esta licencia terminará automáticamente si incumples estos Términos.

Reconocimiento de Apple: Estos Términos se celebran únicamente entre tú y Calorie Camera, y no con Apple Inc. Apple no es responsable de la App ni de su contenido. Apple no tiene obligación de proporcionar mantenimiento o soporte. En caso de que la App no cumpla con alguna garantía aplicable, puedes notificarlo a Apple, y Apple te reembolsará el precio de compra si corresponde, en la medida máxima permitida por la ley, sin ninguna otra obligación de garantía. Apple no es responsable de reclamaciones relacionadas con la App, incluyendo responsabilidad de producto, cumplimiento legal o protección al consumidor. Apple no es responsable de investigar, defender, resolver o descargar reclamaciones de infracción de propiedad intelectual de terceros. Apple y sus filiales son terceros beneficiarios de estos Términos y pueden hacerlos valer frente a ti.

03. Cuentas

Algunas funciones pueden requerir una cuenta. Aceptas proporcionar información veraz, mantener la confidencialidad de tus credenciales y notificarnos cualquier uso no autorizado. Eres responsable de toda la actividad de tu cuenta. Puedes solicitar la eliminación de tu cuenta en cualquier momento — consulta Eliminar mi cuenta.

04. Suscripciones, pruebas y pagos (compras dentro de la app de Apple)

Calorie Camera puede ofrecer suscripciones con renovación automática (p. ej., mensual, anual) y/o acceso de por vida, vendidos exclusivamente mediante compras dentro de la app de Apple.

• Facturación: El pago se carga a tu Apple ID al confirmar la compra.
• Renovación automática: Las suscripciones se renuevan automáticamente salvo que desactives la renovación al menos 24 horas antes del fin del periodo actual. Tu cuenta recibe el cargo de renovación dentro de las 24 horas previas al fin del periodo.
• Gestionar / cancelar: Puedes gestionar o cancelar en Ajustes de iOS > Apple ID > Suscripciones, o en el App Store. La cancelación surte efecto al final del periodo de facturación actual. Eliminar la App no cancela tu suscripción.
• Pruebas gratuitas: Si se ofrecen, cualquier parte no utilizada de una prueba gratuita se pierde al comprar una suscripción, cuando proceda. Las pruebas se convierten automáticamente en suscripciones de pago salvo que se cancelen antes de su fin.
• Cambios de precio: Nos reservamos el derecho a cambiar los precios, cumpliendo las reglas de Apple sobre cambios de precio y preaviso.
• Reembolsos: Todas las compras las procesa Apple y están sujetas a sus políticas de reembolso. No podemos emitir reembolsos directos de compras del App Store — solicítalos a través del Soporte de Apple / reportaproblem.apple.com.

05. Aviso de salud, nutrición e IA

Calorie Camera no es un producto sanitario y no ofrece consejo médico.

• Las estimaciones de calorías, macros y nutrientes se generan por inteligencia artificial a partir de fotos y datos introducidos y son solo estimaciones. Pueden ser inexactas o incompletas.
• No uses la App para diagnosticar, tratar o prevenir enfermedades, gestionar trastornos alimentarios, embarazo u otras decisiones médicas. Consulta siempre a un profesional sanitario cualificado.
• Si tienes alguna condición médica, alergia, trastorno alimentario, o estás embarazada/en lactancia, consulta a tu médico antes de usar la App o cambiar tu dieta.
• Las imágenes que subas pueden procesarse temporalmente en nuestros servidores para su análisis, como se describe en la Política de privacidad.

06. Uso aceptable

Aceptas no:

• Subir contenido ilícito, dañino, de odio, sexual explícito que involucre a menores, infractor u objetable.
• Subir fotos de otras personas sin su consentimiento, ni datos personales sensibles que no desees que se traten.
• Abusar, interrumpir, sobrecargar, extraer datos (scraping) o eludir la seguridad, límites o controles de acceso del Servicio.
• Usar el Servicio para desarrollar modelos competidores mediante extracción sistemática, o para inducir a error con resultados generados por IA.
• Infringir las reglas del App Store, derechos de privacidad o de propiedad intelectual.

Podemos suspender o terminar cuentas que incumplan estas reglas, con o sin previo aviso cuando la ley lo permita.

07. Propiedad intelectual

La App, el sitio web, logotipos, diseño, textos y software pertenecen a Calorie Camera o a sus licenciantes y están protegidos por las leyes de propiedad intelectual. Salvo la licencia limitada anterior, no se otorga ningún derecho. Conservas los derechos sobre las fotos y contenidos que subas («Contenido de usuario»), pero nos otorgas una licencia mundial, no exclusiva y gratuita para alojar, procesar y mostrar dicho contenido únicamente para operar y mejorar el Servicio, conforme a nuestra Política de privacidad. Los comentarios o sugerencias que nos envíes podrán usarse sin restricción ni compensación.

08. Servicios de terceros

El Servicio puede usar proveedores externos (p. ej., análisis por IA, analítica, informes de errores, alojamiento en la nube) y contener enlaces a sitios de terceros. No somos responsables de sus contenidos, políticas o prácticas. Tu uso de los servicios de Apple sigue sujeto a los términos de Apple.

09. Terminación

Puedes dejar de usar la App en cualquier momento y eliminar tu cuenta en Eliminar mi cuenta. Podemos suspender o terminar el acceso si incumples estos Términos, si la ley lo exige o si interrumpimos el Servicio. Las secciones sobre PI, avisos, responsabilidad y ley aplicable sobreviven a la terminación.

10. Exclusión de garantías y limitación de responsabilidad

EN LA MEDIDA MÁXIMA PERMITIDA POR LA LEY, EL SERVICIO SE PRESTA «TAL CUAL» Y «SEGÚN DISPONIBILIDAD», SIN GARANTÍAS DE NINGÚN TIPO, EXPRESAS O IMPLÍCITAS, INCLUYENDO COMERCIABILIDAD, IDONEIDAD PARA UN FIN DETERMINADO, EXACTITUD Y NO INFRACCIÓN. NO GARANTIZAMOS QUE LA APP SEA ININTERRUMPIDA, SIN ERRORES, NI QUE LAS ESTIMACIONES NUTRICIONALES SEAN CORRECTAS.

EN LA MEDIDA MÁXIMA PERMITIDA POR LA LEY, CALORIE CAMERA NO SERÁ RESPONSABLE DE DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES, CONSECUENTES O PUNITIVOS, NI DE LUCRO CESANTE, PÉRDIDA DE DATOS O FONDO DE COMERCIO DERIVADOS DEL USO DEL SERVICIO. NUESTRA RESPONSABILIDAD TOTAL NO SUPERARÁ LAS CANTIDADES PAGADAS POR EL SERVICIO EN LOS 12 MESES ANTERIORES A LA RECLAMACIÓN, O 100 € / 100 $ SI NO PAGASTE NADA. NADA EN ESTOS TÉRMINOS EXCLUYE LA RESPONSABILIDAD QUE NO PUEDA EXCLUIRSE SEGÚN LA LEY DE CONSUMO APLICABLE.

11. Cambios, ley aplicable y disputas

Podemos actualizar estos Términos ocasionalmente. Publicaremos los cambios en esta página con una nueva fecha de actualización y, cuando proceda, te avisaremos en la App. El uso continuado tras los cambios implica aceptación. Estos Términos se rigen por la ley aplicable sin referencia a normas de conflicto de leyes. Los consumidores de la UE conservan las protecciones imperativas de su país de residencia.
